Texas | DUI

 dui
STARLAW.US
Driving Under the Influence in life, there are many times when we make poor judgment calls and end up in situations that we wish we were not in but don’t see a way out. Drunk driving is a serious offense in Texas but you should have to spend your whole life making up for one mistake. The defense attorneys at on starlaw.us recognize the gravity of a DUI charge and know it may not have been entirely your fault, or any fault of yours at all. Breathalyzers, blood testing, BAC testing are never 100% reliable. If you would like to fight the state and potentially save your drivers license, contact The the lawyers on starlaw.us and they will schedule a free session to analyze your case at a reasonable and low cost.

Once a DUI has been issued, there are two separate proceedings that you need to be aware of. One is the criminal case where you will be assigned a court date and will need to plea and answer to your charges while the other is a DMV hearing to discuss the status and possible revoking of your license. Nobody wants to enter these meetings alone, and in fact if you have a defense lawyer they may show up in place of you in court if the charge is just a misdemeanor. This saves you the time and unease of having to stand before a court pleading your case. Your lawyer will have all information necessary for you such as lab reports, information on the condition of the Breathalyzer, any police reports, and whatever other information is available and will help your case. If no agreement is met between you and the prosecutor, you will have the option to attend a bench trial where you will appear before a judge. In this case, you may plead and be found Not Guilty!

Did You Know?
Police are no better than the average drinker at determining whether someone is or isn’t drunk. They do get it wrong half of the time and in these cases it is clearly not the driver’s fault.
Police must follow a specific protocol when it comes to roadside sobriety tests. Many times they do not follow these procedures and you can use this to your advantage when providing evidence in court.
It may sounds silly, but Breathalyzers are built to pick up readings for things such as heartburn, braces, and even old alcohol remnants in your mouth.

It’s so important to have a defense attorney by your side when fighting any case especially a DUI charge. There are too many things that can go wrong and you shouldn’t take a chance on the rest of your life in jail, or the revoking of your license. There are ways to fight these things off and contact a lawyer on starlaw.us Don’t just plead guilty to a crime that you may have not committed.

STARLAW.US
The fact that some states allow you to grow, purchase, and possess this drug makes it hard for some people to know what is allowed and what they will get in trouble for. But when it comes to the state of Texas, growing marijuana is illegal and could have some big penalties that come with it. If you are caught growing marijuana in the state of Texas, make sure that you get the right criminal defense lawyer on your side as soon as possible.

Any act of growing this drug, whether you just have one plant or a whole factory of them, is illegal in the state of Texas. This could result in some heavy penalties and the type of class felony you face, and all of them are considered felonies, will vary. This is why it is so important to get the help that you need from a criminal defense lawyer as soon as possible. This ensures that you are given the proper treatment from the beginning and can even reduce some of the charges.

Penalties for Growing Marijuana

In Texas, as well as most other states in this country, the penalties for growing this drug are going to vary depending on how many times you have been caught doing this process as well as how many plants are being grown in the area. In addition, if you are growing the plants in an area that is a drug free zone, such as within 1000 feet of drug treatment facilities, schools and youth centers, the penalties are going to be much worse, even if you just grow a few plants. So let’s look at some of the penalties that are available.

Growing 1 to 4 plants—if you are convicted, you will have a Class 1 felony. You could spend more than three years in prison and your fine could be a maximum of $10,000.

Growing 5 to 20 plants—this is a Class H felony if you are convicted with this many plants. This could put you in prison for six years and cost you $10,000.

Growing 21 to 50 plants—this one is considered a Class G felony. If convicted, you could spend more than 10 years in prison and have a fine of $25,000

Growing 51 to 200 plants—this many plants will get you a class F felony. If convicted, you will spend 12 years in prison and have a fine of $25000.

Growing more than 200 plants—this will be considered a Class E felony and you could spend 15 years in prison and be fined $25,000.

Drug free zones—if you grow the plants near jails, housing projects, pools, parks, youth centers, or schools, you will spend an extra 5 years in jail on top of your original penalty.

As you can see, growing any amount of marijuana in the state of Texas can be a huge offense. You need to make sure that you are finding a good criminal defense team who is willing to work with you from the beginning to come up with a good defense. The courts are not going to look highly on this kind of offense, especially if you were growing in an area that is considered drug free. A good criminal defense lawyer will be able to look at your case and determine which outcomes are the best or even get the kind of felony reduced to something that is more manageable. Never try to defend yourself in these cases, contact a criminal defense lawyer to give you the help that you need.
